1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the itpmschool.com website and all related services (collectively, the “Service”) operated by Dmytro Nizhebetskyi IT Project Manager JDG, a sole proprietorship registered in Poland (“Dmytro Nizhebetskyi,” “we,” “us,” or “our”).
Please read these Terms carefully before using the Service. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree with any part of these Terms, you must not access or use the Service.
These Terms apply to all visitors, users, students, subscribers, and others who access or use the Service.
2. Eligibility
You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are between 16 and 18 years of age, you confirm that you have obtained parental or guardian consent to use the Service.
If we learn that a user is under 16 years of age, we will terminate their account and delete any associated personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of these Terms and may result in immediate suspension or termination of your account.
You are responsible for safeguarding the password you use to access the Service and for all activities that occur under your account. You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any unauthorized use of your account or any other breach of security.
You may not use as a username the name of another person or entity without appropriate authorization, or any name or trademark that is subject to the rights of another person or entity, or any name that is offensive, vulgar, or obscene.
4. Purchases and Payments
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase, including your payment details, billing address, and other necessary information.
You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Purchase; and (ii) the information you supply to us is true, correct, and complete.
By submitting such information, you grant us the right to provide the information to third-party payment processors (including Paddle, Stripe, and PayPal) for the purpose of facilitating the completion of Purchases. We use industry-standard security measures to protect your payment information and do not store full credit card details on our servers.
We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, errors in the description or price of the product or service, errors in your order, or suspected fraud or unauthorized or illegal transactions.
5. Subscriptions
5.1 Billing Cycle
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing Cycles are set on a monthly basis unless otherwise specified at the time of purchase.
5.2 Automatic Renewal
At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal at any time through your online account management page or by contacting us at dmytro@itpmschool.com. Cancellation will take effect at the end of the then-current Billing Cycle; you will continue to have access to your Subscription until that date.
5.3 Payment Methods
A valid payment method, including credit card or PayPal, is required to process payments for your Subscription. You shall provide us with accurate and complete billing information. By submitting such payment information, you authorize us to charge all Subscription fees incurred through your account to your designated payment method.
Should automatic billing fail for any reason, we will issue an electronic invoice indicating that you must proceed manually with the full payment within the deadline specified on the invoice.
5.4 Fee Changes
We may modify Subscription fees at any time in our sole discretion. Any fee change will become effective at the end of the then-current Billing Cycle. We will provide you with at least 30 days’ prior written notice of any fee increase, giving you an opportunity to cancel your Subscription before the change takes effect.
Your continued use of the Service after a Subscription fee change comes into effect constitutes your agreement to pay the modified fee.
6. Right of Withdrawal (EU Consumers)
If you are a consumer located in the European Union or European Economic Area, you have the right to withdraw from a purchase within 14 days of the date of purchase, without giving any reason, in accordance with EU Directive 2011/83/EU.
To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement (e.g., by email to dmytro@itpmschool.com) before the 14-day period expires.
If you have requested that the performance of a digital service or the supply of digital content begin during the withdrawal period, you acknowledge that you may lose the right of withdrawal once the service has been fully performed or content fully accessed, provided that you gave your prior express consent and acknowledged the loss of the right of withdrawal before delivery began.
Upon valid withdrawal, we will reimburse you using the same payment method used for the original transaction, within 14 days of receiving your withdrawal notice.
7. Refund Policy
Beyond the EU right of withdrawal described in Section 6, our full Refund Policy is available as a separate document on our website and is incorporated into these Terms by reference.
To request a refund, please contact us at dmytro@itpmschool.com with your order details and the reason for the refund request. We will respond within 14 business days. Refunds, if granted, will be processed to the original payment method within 14 days of approval.
8. User Content
Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are solely responsible for the User Content that you post, including its legality, reliability, and appropriateness.
By posting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service for the purpose of operating and providing the Service. You retain all of your ownership rights in your User Content.
You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms; and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.
We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms, is objectionable, or may expose us to liability.
9. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Dmytro Nizhebetskyi IT Project Manager JDG and its licensors. The Service is protected by copyright, trademark, and other laws of Poland and foreign countries.
Our trademarks, trade names, and trade dress may not be used in connection with any product or service without our prior written consent.
10. Availability, Errors, and Inaccuracies
We continuously update our product and service offerings. Products or services may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information.
We do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
11. Links to Third-Party Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites or services.
12. Termination
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity provisions, and limitations of liability.
If you wish to terminate your account, you may do so by contacting us at dmytro@itpmschool.com or by discontinuing use of the Service. For active Subscriptions, please cancel your Subscription before requesting account termination.
13. Indemnification
You agree to defend, indemnify, and hold harmless Dmytro Nizhebetskyi IT Project Manager JDG and its officers, agents, partners, and employees from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including any copyright, intellectual property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.
14. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Dmytro Nizhebetskyi IT Project Manager JDG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty euros (€50), whichever is greater.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including mandatory EU consumer protection laws.
15. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
This disclaimer does not affect any statutory rights that cannot be waived or limited under applicable law, including EU consumer protection laws.
16. Data Protection and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Polish data protection laws. The Privacy Policy is available on our website and is incorporated into these Terms by reference.
17. Dispute Resolution
If you have any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at dmytro@itpmschool.com. We will endeavor to resolve the dispute through good-faith negotiation within 30 days.
If the dispute cannot be resolved informally within 30 days, it shall be submitted to the competent courts of Poland. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence.
As an EU consumer, you also have the right to submit a complaint through the European Commission’s Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
18. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, war, civil unrest, power outages, internet or telecommunications failures, pandemics, or cyberattacks.
19. Governing Law
These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. If you are a consumer residing in the European Union, you will also benefit from any mandatory provisions of the law of the country in which you are resident.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.
20. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision constitutes a material change, we will provide at least 30 days’ notice before the new terms take effect.
We will notify you of changes by posting the updated Terms on the Service and, where possible, by sending you an email notification. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Service.
21. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements relating to the Service.
